Deputy Marshal John Pemberton was shot and killed in Oklahoma while trying to arrest a man who had assaulted another marshal.
Deputy Marshal Pemberton was part of a posse that was attempting to arrest the suspect. The posse was confronted by a large group of people who attempted to prevent the arrest. A shootout ensued in which Deputy Marshal Pemberton was killed and another deputy marshal was wounded.
Four men were arrested and tried for his murder. All four were found not guilty because no one could testify that they had seen them fire at the marshal.

View all 6 ReflectionsJust info on John Pemberton. Although I'm still trying to figure out if I am related I have found some updated information. I found burial records at the Fort Smith Public Library in the Birnie Brothers undertakers funeral log books. John was 23 years when he died and is buried at the Mayfield Cemetery, IT (Indian Territory). I looked for a head stone but, didn't fine one. I also tried to contact the cemetery but, no one has returned my phone calls. I do have a copy of the Police report and is says Bailey used a Winchester to shoot Pemberton.
I am still researching John Pemberton.
